I certainly have seen instances where full capacity is lower than sub capacity, though it would be considered atypical. I'd recommend licensing the lower of either full or sub cap for the cost savings. If licensing via full cap it is important to continue to monitor the size of full vs sub cap from both a cost and compliance perspective.
In relation to your first question the PVU calculation is dependent on the underlying hardware. In sub cap the PVU per core and the number of cores are the 2 relevant variables needed.
